Terms of Service

These Terms of Service (“Terms”) govern your use of Arka: Voice Alarm (referred to here as “Arka”), the iOS app distributed through the App Store. By downloading or using Arka, you agree to these Terms. If you do not agree, please do not use the app.

Subscriptions

Some features of Arka are available only with a paid subscription. You will be billed in advance on a recurring and periodic basis, depending on the plan you choose (“Billing Cycle”). Your subscription will automatically renew under the same conditions unless you cancel it before the end of the current Billing Cycle.

Subscriptions are sold and managed through the App Store. You can manage or cancel your subscription at any time through your Apple ID account settings.

Free trial

We may, at our sole discretion, offer a subscription with a free trial for a limited period of time. You may be required to enter your payment details to enrol in the free trial. If you do not cancel the subscription before the trial ends, you will be charged the applicable subscription fee. We reserve the right to modify or cancel free trial offers at any time without notice.

Fee changes

We may adjust subscription fees at our discretion. Any change to subscription fees will become effective at the end of your current Billing Cycle, and we will provide reasonable prior notice so that you have an opportunity to cancel before the change takes effect.

Refunds

Except when required by law, paid subscription fees are non-refundable. Refund requests for purchases made through the App Store are handled by Apple under their published refund policy.

Your content

Voice clips you record stay on your device. When you choose to share a voice clip with a friend, you grant Arka a limited, non-exclusive licence to store and transmit that clip solely for the purpose of delivering it to the recipient you selected. You retain all rights to your voice clips.

You agree not to use Arka — and in particular the sharing feature — to upload, transmit, or share:

• Content that is illegal, hateful, harassing, threatening, or sexually explicit, especially involving minors.
• Content that infringes someone else’s intellectual property or privacy rights.
• Recordings made of other people without their consent where consent is legally required.

We may remove shared voice clips and suspend accounts that violate these rules.

Intellectual property

Arka and its original content, features, and functionality are and will remain the exclusive property of Arka and its licensors. The app is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Links to other websites

Arka may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason — including if you breach these Terms. Upon termination, your right to use the app will cease immediately. Voice clips stored on your device will not be affected by account termination.

Limitation of liability

To the maximum extent permitted by law, Arka and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, use, goodwill, or other intangible losses — resulting from your use of, or inability to use, the app.

Disclaimer

Your use of Arka is at your sole risk. The app is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied. We do not guarantee that the app will function uninterrupted, securely, or be available at any particular time or location, or that any errors will be corrected.

Changes to these Terms

We reserve the right to modify or replace these Terms at any time. If a change is material, we will provide at least 30 days’ notice before the new Terms take effect when reasonably practicable. By continuing to use Arka after revisions become effective, you agree to be bound by the revised Terms.

Governing law

These Terms are governed by the laws of Ukraine, without regard to its conflict of law provisions.
